And so begins my legal odyssey against strip club entrepreneur Charles G. “Jerry” Westlund, Jr., a.k.a. THE KOOL AID MAN, a derisive term used behind his back by the dancers that refers to his appearance. In the real world, he's got that whole Tom Arnold thing going . . . the way he bounces from foot to foot like he needs to make wee wee. I have never seen females humor a man the way they humor Westlund, a geekboy who uses his wallet to play Alpha-Male. As a fellow Jew from the L.A. strip club scene, I thought he'd do me better than this.
I have been in touch with Michael Erskine of The Commercial Appeal, verifying that Westlund illegally lives in the complex of suites located at 631 Madison Avenue, behind Downtown Dolls, located in the former Club 616 building on Marshall, in the part of the city known as "The Edge". Westlund, his general manager with his baby momma and two babies, a manservant, and visiting XXX Porn features all live and party in the compound that is zoned for commercial use only . . . I describe it as "Part den of iniquity, part day care center". Locally, Westlund is the owner of The Pony, Black Tail, Downtown Dolls and part owner of The Jet Strip, along with clubs in Los Angeles, South Carolina, Missouri and, Illinois.
After the December 16, 2007 article DOLLS STILL OPEN DESPITE LAWSUITS, I agreed to allow Mr. Erskine to break my story in The Appeal, as a matter of courtesy on the former story which he launched. They are now on the clock . . .

I have, as of April 2, 2008, complied with their request and service of Westlund is imminent. I will now provide The Commercial Appeal the opportunity of taking my story public first, so long as they are willing to do it justice in my eyes. This story is much bigger than Memphis, as strip clubs are a scourge nationwide, because of the criminal element that it attracts and the violent mix of cocktails and strippers . . . especially the clubs in urban centers. I seek to lend my years of insight into the problem, in order to preserve our strip club heritage for generations yet unborn.

Now, like it or not, a strip club is a legal venue and a place of business where people go to work for an employer and therefore is subject to workplace standards, concerning discrimination, harassment, activities and protection. Even though sex is not illegal, you can't fuck on your desk at work. If an employer violates the law, by allowing employees to break the law, he puts his innocent employees at risk of being arrested and jeopardizes the business and the industry and everyone suffers when they get shut down.
Here in Memphis, The Platinum Plus rained money every night, because the management looked the other way for a fee while the dancers turned tricks in the VIP Lounge. I was working at Christie's Cabaret when Platinum closed, and the customers were so disillusioned when all they could get was a lap dance in the VIP. Allowing the chicks to trick was a shortsighted plan, because now no one makes money there anymore. When Platinum closed, The Pony was limping along with few women and a small customer base. So Westlund brought them all over to The Pony, which he advertises as “The New Platinum” . . . an obvious code that they give action like the Old Platinum.
I have no problem with hookers or the concept of prostitution, but it must be kept out of the workplace. If a few girls are bobbing knobs and knocking back quickies in the VIP Lounge, it is not fair to the majority of dancers who come there to dance on stage and do lap dances, per their job description. They can't make money if other females offer more than is allowable . . . it's cheating. Plus, it forces the others to engage in these acts in order to make their ends meet.

Being in a cash daily business is a competitive grind and one bad night or two can do you in, so the playing field must be level. In all my years as a deejay and a manager in Hollywood and here in Memphis, I always gave every dancer their fair share and never took bribes to put females up out of turn or leave them off stage or let them do some guy even if they tipped me better than other dancers or were one of my soirée ladies . . . just ask them and they'll tell you. I live for integrity.
When I was promoted to manager at The Pony to work the VIP Lounge, I would not allow dancers to turn tricks and when I continued to send them to the upper management and nothing was done, I was the problem and on that basis they fired me.

Only a week before, they were promoting me to assistant manager of their new location in East Cape Girardeau, Illinois, where I would take over as lead manager when the manager, Blake, a former manager at Platinum Plus, moved on. I worked a weekend there as deejay, and Blake told me that since the club was out in sticks they could get away with allowing the girls to “whatever” in the VIP Lounge. When I told Westlund that this was a mistake and that Blake would get the club closed like he did Platinum, I was fired, two days later, costing me a $50,000 per year gig. It is on this basis that I have filed this lawsuit under Whistle Blower's Law.
WHISTLE BLOWER'S LAW: An Employer may not take any reprisal against an employee that advises the employer that the business is in violation of a law and the employee either discloses, threatens to disclose or testifies about the violation of the law, or the employee objects or refuses to participate in an employment act in violation of the law. This law may be found at Tennessee Revised Statutes Title 50-1-304
I do not undertake this lawsuit with any belief that it will pay off; in fact it will cost me my livelihood, after 30 legendary years in the industry rocking the mike and the ladies like no other. I will now be a pariah, the proverbial “Deep Throat” of the strip club world. . . only I will voice my testimony in public on Front Street for a greater good than my own sense of vengeance or justice or image, to shine the spotlight on the dark auspices of the industry in order to save it from itself, because of owners like Westlund.
He and his powerhouse attorney Edward Bearmann will hit me with motion after motion then appeal any judgement in my favor for many moons, but I ain't backing up. I can't get any of the crusading discrimination lawyers in town to touch this case on contingency, because they do not wish to be viewed as “Pro Strip Club”. But since I am much higher on the intellectual food chain than an attorney, I'll be fine going forward on my own and I will go forward for as long as I can . . . if for no other reason than to hear Westlund testify that he runs a clean club even though he has hired the dirtiest managers in the business to run it.
At the time I was employed, through October 2007, 3 of the 5 night managers were from Lunati owned defunct clubs, and both managers of his out of town area clubs had Lunati managers . . . after I was fired, another former Lunati manager was hired in my place to “manage” the VIP lounge making it 4 out of 5. It must've been like returning to the scene of the crime, when all the managers and all their hookers reunited with their customers at The Pony.
The drones on the city council, here and nationwide, focus on the immorality of the strip clubs, they call for upholding religious values and societal mores and they are shot down in one word . . . FREEDOM. There should not be laws in a strip club; we know we have lost all touch with reality when we arrest strippers for indecent exposure in a strip club. Here in the carjacking/murder capital of Memphrica, we certainly do not need police deployed in strip clubs and focusing tax dollars on sting operations in the VIP Lounge in a city where too many school kids don't have seats or books. The strip clubs have their own simple code that supersedes any law . . . NO penetration of the dancer and NO exposure of the male. That's it! The rest falls under the heading of MIND YOUR GODDAMN BUSINESS! Most dancers abide by this code . . . if it is enforced by the management.
What would be more useful in these matters is to monitor the strip clubs from inflicting themselves on society and initiating rules to protect the industry from getting greedy and scandalous.

Strip clubs should not be allowed to advertise in the newspapers when it is important to make kids socially aware by reading the paper. An article about strip clubs is socially responsible, but gratuitous ads with erotic overtones and scantily clad ladies are wholly unsuitable for minors. These newspapers savage the strip club industry on moral grounds and call themselves "family newspapers" then sell them big giant honking running ads . . . reaching a level of hypocrisy rivaled only by religion.
Strip clubs should not be able to put up billboards with suggestive slogans or females erotically posed. This forces parents to have conversations with children they may not be ready to have. Head shots only of females, the name of the business and its location and the slogan “a gentleman's club” is all that needs to be publicly displayed . . . we get it.
The same rule applies to these mobile advertisements wrapped around vehicles. The Pony has theirs on the side of a moving van. There is nowhere to hide when they go rolling through town. It's also bad business to piss off the community you're seeking to cultivate. A guy may want to go to a strip club, but wouldn't want his children or his wife to have these ads waved in their faces.
The strip clubs should not have blatantly sexual names or signs outside promoting erotica. They should all ONLY have a sign that reads “a gentleman's club”. While it is ludicrous to say that a woman showcasing her beauty for men for money is demeaning to all women, since it involves no other woman but the dancer, it is denigrating to see clubs with signs that refer to women like slabs of beef seved up for money.
There should not be signs announcing XXX porn stars with their salacious screen names. These signs are in full public view and it is impossible to put blinders on minors. These signs represent an unsuitable public presentation of females, because it has no context. It can be damaging to the psyche of young females who will judge their beauty and sexuality compared to the image of the strippers. The objectifying ads will also impede young males from respecting females individually, because they haven't gained the experience or the maturity to realize that not all females are tattooed tramps that you have to financially haggle with in a dark corner of a seamy night club in order to get some action.
Inside the club, there should not be secluded, guarded VIP areas, because that level of privacy creates an opportunity for prostitution. Take down the curtains and have the lap dances in full view of the club, so there is no intercourse and oral sex going on.
These rules are not about restricting the personal freedoms of some; it is about protecting the rights of those who don't want to have to deal with it. While it is true that no one has ever been brought to a strip club at gunpoint and forced to watch the stripping women, these overt advertisements bring elements of the strip club into people's lives against their will. With every right comes an equal responsibility. You are free to smoke all you want, but you cannot exhale in my presence because it takes way my right not to smoke.
Westlund has an extensive arrest record for political tampering, embezzling, fraud, forgery and tax evasion from his days as a player in the Card Club. Though he allegedly skimmed over $350,000 and scammed people on real estate deals in the millions, he managed to buy his way out of most of these charges, because the prestigious Bicycle Club did not want the negative publicity their association with him would bring.
But he took a collar for tax evasion and had to do 2000 hours community service and serve 7 years probation. It is not clear if he lied on his application for a license in Memphis or revealed that he was still on probation when he applied. He lied on his application in Lubbock, Texas and they closed his club down and ran his ass out of town. Perhaps this is the loophole they need to hang this charlatan .
I will make myself available to the vapid City Council that is grappling with the strip club situation with no clue as to how they can control the action. No one is going to buy a lap dance from a girl who has to stand six feet away, so no one is going to abide by such an arbitrary ruling. These are not laws, we're talking about; they are manmade violations, that should not be respected. No man ever called the cops to complain that he received an erotic lap dance against his will, so keep the law out of it. The council must realize that they can only take control of how a strip club impacts a community from the outside, because on the inside it is not their concern, unless someone breaks a law . . . like prostitution.
I tried to get all the GMs talking, so when a dancer robbed a customer or turned a trick, she would get blackballed, so that we weren't passing trash back and forth. In LA we had that kind of mutual cooperation, because we understood that we were each responsible to maintain the industry for our own good. These GMs must be forced to the table to take responsibility for the dancers they hire.
Despite being a big money guy, I feel sorry for Westlund, who is a pathetic caricature of a Vegas pit boss. He spends fortunes to get into places where he is not welcome and they gladly take his money then shun him. In 2007, he paid $70,000.00 to enter the Toyota Pro/Celebrity Race at the Long Beach Grand Prix---his hometown where he is reviled. The local papers took great pleasure in calling him “The Uncelebrity” of the race.
In spite of all his tummy tucks, lipposuction and plastic surgery, he is still a self loathing blob that can't bear the sight of himself, so he tries to dazzle people with his wallet, without ever scraping up enough to buy their freindship, their love or even their respect. The people that work for him and live with him have never uttered a kind word about him . . . because he hasn't earned it. Jerry pays people money so they will take his abuse; he wants them to feel as bad about themselves as he feels about himself. And they loathe him for it.
He is too insecure to make friends with people who have intellect or personality, so he surrounds himself with lackluster fops that are nod men. He's so insecure about his sexuality and his endowment that he actually became jealous over his heroin addict manservant dating ladies from the club. In order to keep his job, he agreed to only have sex with the Black women Jerry avoids.
In the club, Westlund trolls for blow jobs, shoves his hand into girl's thongs and tells them that they're bitches who aren't worth shit . . . payback for all the women that left him spraying his sheets as a lonely teen, before he got enough money to pay for their pleasure. Men like this feel better about themselves when they mistreat women, so they don't feel like such losers for being rejected and needing to pay for play. That's why they call him "The Kool Aid Man" and they call me "The Kingpin".

I make it clear that Westlund's style is not par for the course. I deejayed in clubs for 20 years in LA without getting closed down by the law and the family that I worked for are still in business. When a chick gets popped there, she's out of the business for good no matter what kind of porn credits she has or how beautiful she is. Most owners know that you stay in business by playing it straight . . . the same goes for the dancers. Steve Cooper doesn't tolerate any form of prostitution in his clubs and the managers know it. They do integrity tests and try to set you up to take bribes using managers and dancers and if you bite your ass is gone. That's why he stays in business without all the fines. Cooper saw how Danny Owens ruined his club and then his old pal Ralph Lunati, who is in currently in prison for turning his club into a brothel/drug den, went down in flames. Westlund is trying to play the role of big shot and like Owens and Lunati he has put himself at the top of the hit list . . . it won't be too long before he gets taken down and The Pony is a Chinese Food Restaurant.

Card Club's Political Consultant Indicted in Theft of $380,000
Crime: Ex-official pleads not guilty to accusations that he used money to
buy apartment houses in Compton and Long Beach.

A former political consultant for the U.S.-controlled Bicycle Club casino
has been indicted on charges of embezzling hundreds of thousands of dollars
from the card club's political campaigns.
Authorities said Charles G. "Jerry" Westlund Jr. embezzled $380,000
from the casino and its campaign committees, and used the money to buy
low-rent apartment houses in Long Beach and Compton, among other purchases.
An indictment returned by the county grand jury also charges him with
two counts of forgery and six counts of failing to file state tax returns.
Westlund, 32, is a former appointee to a state narcotics parole board
and a well-known figure in California's card club industry.
He pleaded not guilty at his arraignment Thursday. Superior Court
Judge Jacqueline Connor ordered him to surrender his passport and released
him. He is to return to court Dec. 18 for a bail hearing.
After his arraignment, Westlund told reporters: "There's not a chance
I'm talking."
His lawyer, Douglas W. Otto, said he had not yet reviewed the evidence
against his client, but that "everything he spent was authorized by his
employer."
His employer was a trustee for the federal government.
The U.S. Justice Department seized a controlling interest of the
casino in 1990 as part of a narcotics money laundering case. Since then, a
federally appointed trustee has supervised the casino for the U.S. Marshals
Service, the arm of the department assigned to maintain seized assets.
A U.S. Marshals Service spokesman said the agency had not been asked
to submit any information to the county grand jury, and declined to comment
on the indictment.
For the Justice Department, the casino is the most valuable asset ever
seized, yielding more than $30 million in profits. It is expected to make
$22 million or more in a planned sale of its share to a British gaming
company. But the department has also been buffeted by accusations of
mismanaging the card club.
Westlund is the second Bicycle Club consultant to be indicted while
the U.S. Justice Department has been overseeing the casino. Hollman Cheung,
the former manager of the club's lucrative Asian games section, was
arrested in 1994 and later imprisoned for loan sharking, conspiracy and
extortion.
Westlund's attorney added his voice to the chorus of government
critics Thursday.
"What is the federal government, stupid or incompetent?" he asked.
"Until I get [the evidence], I can't answer that."
Harry Richard, a Las Vegas casino executive who became the
government's trustee and ran the casino from 1993 until he was forced to
resign last year, has denied that he knew how Westlund spent the club's
political contributions.
Richard said the notion that he would approve illegal expenditures
"doesn't make any sense."
During most of its involvement with the casino, the Justice Department
allowed the Bicycle Club to take an active role in California politics as
more than a dozen cities held elections in recent years to decide whether
to open rival casinos.
With Richard's approval, the casino poured more than $750,000 into its
effort to persuade voters to oppose new card clubs in 1995, state records
show. Since Richard resigned, the casino has not reported making any
political donations.
Westlund's political operation was widely successful. Voters defeated
the ballot measures in all but one city.
The casino's contributions went to three political action committees:
Concerned Taxpayers of California, Californians Against Gaming Expansion
and Public Information Service. Investigators believe that Westlund
embezzled some of the money by directing the committees' checks to post
office boxes he owned. To hide the theft, investigators believe, Westlund
tried to disguise the people he paid as people who worked for the campaign.
Much of the money, authorities said, went to Westlund's real estate
purchases. At one point he owned 202 rental units in Long Beach and
Compton, but the titles to many of those properties have been transferred
to corporations controlled by his father, they said.
Investigators believe that Westlund used the committees' money to pay
for construction work on his personal property and to make payments on a
car loan, documents show.
Among the witnesses called before the grand jury were a Los Alamitos
used-car dealer who investigators say was involved with the car loan, and a
Colorado sports promoter who said in an interview that he sold Westlund a
trip to Havana. Both were paid for with the Bicycle Club's political
contributions, according to campaign documents.
The indictment also states that Westlund forged another person's
signature on an IRS tax form and on a $7,000 check. He also failed to file
tax returns for the last three years, it states.
If convicted on all charges, Westlund faces 10 years in prison.

As previously reported on Striporama, Baby Dolls club in Lubbock have lost the fight to remain open.
Monday's decision means the strippers can no longer dance inside the club, but it does not mean the owner, Charles Jerry Westlund, Jr., has to shut the place down completely. "It would be a bar that sells mixed beverages so that permit would still be active," says Claude Jones, Lubbock Police Chief.
Westlund's Attorney Jan Fouts believes his client was cheated of his constitutional rights. Fouts says Westlund's California felony convictions were reduced to misdemeanors and the city failed to recognize that when considering Westlund's application.
"We believe the decision was not a correct decision but the board certainly was acting on what they believed," said Fouts.
Fouts plans to file the case in a higher court and has ten days to do so.

Lubbock's Only Strip Club Could Be Closing It's Doors
It's the only strip club inside the Lubbock city limits. It was once called Players, but it's now called Baby Dolls and is painted bright pink on the outside.
Charles Westlund of California bought Players from a Lubbock lawyer in August. He updated the business information in order to keep the permit and, at the same time, he tried to renew his permit for next year. But the Lubbock Police Department rejected it.
Police Chief Claude Jones told NewsChannel 11 over the phone the reason was because Westlund failed to give complete information on the application. However, Jones would not tell us exactly what was missing. But city councilman Tom Martin did. Martin says Westlund failed to fill out his criminal history because he has a criminal background.
NewxChannel 11 tried to contact Westlund in California but was not able to reach him. Westlund is appealing his case to the Permits and Licensing Board. It's a group of citizens who will decide if the decision will stand or if Westlund will get his permit. The city of Lubbock has not set a hearing date yet.
Currently sexually oriented businesses are not allowed inside the city limits, but this particular club was operating under a grandfather clause because it existed before the ordinance. This building is operating under a sexually oriented permit, so city councilman Tom Martin says as long as it remains the same type of business, the ownership does not matter.
NewsChannel 11 did some research and found information in other reports that Westlund owns several strip clubs in Memphis, Tennessee and California.
So, did "General" Gibbons know about any of this prior history on Westlund? Did they know this when P.T's Showgirls (the current Pony Club) was shut down in February of 2004 before they let Westlund buy that club? Did they know Westlund was a crook when they let him buy the King of Clubs (the current Blacktail Shake Joint)? when it was shut down the 1st 2 times? Or when the "General" cut the latest deal to let him reopen the Blacktail in December? Sounds to me as though there is a problem with how the City and the "General" handles its politics. In one hand 2 clubs (Platinum Plus and the Cabaret) can stay shut for 4 months with no pending deals announced. In the other hand, a crook who has been chased out of Long Beach then Lubbock is allowed to keep operating in Memphis. If that ain't an example of the MEMPHIS WAY or how much of a hypocrite the "General" is then I don't know what is!!!!

Shelby County's sexually oriented businesses took a hit Monday when
County Commissioners approved on third and final reading an ordinance that will strictly regulate the local industry.
The new law, which goes into effect Jan. 1, will restrict the sale and consumption of alcohol, establish a five-member board to regulate the industry and require that all employees obtain a work permits.
It will apply to all cabarets and sexually themed bookstores,
movie theaters, escort services and massage parlors in unincorporated Shelby County and Memphis.
Although there were concerns -- some commissioners wanted tighter
laws -- the ordinance was approved on an 11-0 vote. J.W. Gibson
passed and Joyce Avery was absent.
Mike Ritz, one of the more vocal advocates, said this law goes a long way toward cleaning up the area's notoriously naughty clubs.
"They're going to have to find new ways of doing business," Ritz
said. "Hopefully the community will be better off."
The county ordinance is the latest attempt by lawmakers to curb
illegal activity in the area's clubs, following an undercover sting last December that shut down Platinum Plus and Tunica Cabaret and Resort.
Days after the raid, consultant Eric Damian Kelly released a report
showing widespread violations by the area's adult businesses. Then in April, controversy surfaced following rumors that strip club owner Steve Cooper may try to open a club in Cordova.
The ordinance adopts the provisions of the state's Adult-Oriented Establishment Registration Act of 1998, a so-called "local option state law."
It's been used by counties across the state and has withstood at
least two legal challenges. If the commission had adopted an altered
version of the ordinance, there were fears it might not be as strong in a court challenge.
"This is tried and true," said Commissioner Wyatt Bunker.
The law will apply in unincorporated areas of the county and in Memphis, the only municipality without its own ordinance on the books. But if Memphis chooses to enact its own law, it would supercede the county's ordinance, said Asst. County Atty. Robert Rolwing.
However, if a business owner were to challenge a future Memphis
ordinance and a court were to declare it unconstitutional, then the county's ordinance would automatically take effect. "That's a real serious backup," Ritz said.
Memphis City Councilman Jack Sammons, who chairs the council's public safety committee, said they've had only preliminary talks of setting a Memphis law. Nothing will be decided until after the Oct. 4 election, when seven new council members join the panel.
Sammons said he would not oppose allowing the new county ordinance to take effect in Memphis. "Frankly, it would be my preference," he said.
Commissioner Mike Carpenter said if the council enacts a
substantially more lenient law, the problems won't be solved.
Although he voted for the ordinance, he urged his colleagues to hold off and draft a joint city-county version after the city
elections. "I want to be sure we get it done right," he said.
Some commissioners wanted to expand the law.
Commissioner Henri Brooks asked if there was any way to regulate
hourly rate motels, which she called "houses of prostitution." They are not included in the ordinance, but officials said they could be regulated with nuisance laws.
Commissioner Steve Mulroy said he plans to work with a county
attorney to create stiffer zoning laws preventing adult businesses
from being "grandfathered in" to nonindustrial areas.
Attorney Price Harris, who represents a company in which Cooper is a shareholder, said the ordinance was an attempt to censor adult business owners.
"I would urge caution," he said. "What we get down to is a freedom of expression."
Jerry Westlund, owner of local clubs including The Pony, called this an attempt by uninformed lawmakers to shut the local business down.
"This is not an attempt to regulate, this is an attempt to run us out of town," Westlund said. "Bad politics does not make good public policy."
Others were overjoyed. Community activist George Kuykendall has
fought for years to get tougher laws on the books.
"I urge the city to follow suit," he said.

Blake was the mnanager and he was a total asshole. He would tell girls straight out that they had to do more if they wanted to make money. A strip club in Memphis has struck an agreement with prosecutors allowing it to reopen in 10 months with a clean record and a new name.
The Black Tail Shake Joint, with a name that is a series of double entendres, faced a claim of being a public nuisance. The agreement with owner Charles Jerry Westlund does not affect prostitution charges filed against several former dancers, the Memphis Commercial Appeal reported.
Westlund, who owns three other strip clubs, must keep the club shuttered until Dec. 10. He is also barred from selling it to anyone for use as an adult entertainment venue.
Obviously, as a result of being closed for 10 months, the owner is going to suffer a significant financial loss, Shelby County District Attorney Bill Gibbons said in a news conference in front of the club.
But the club, once it reopens, starts fresh. While authorities can bring new charges if they believe the club has crossed the line, any past charges cannot be used in a legal case.

Labor Board Rules in Favor of Strippers

LONG BEACH — A local cabaret has been ordered by the state labor board to pay two strippers more than $50,000 in unpaid wages and "stage fees' the women had to pay when they performed.
In February, Cynthia DeMassi of Long Beach and Shenandoah Malaise of Los Angeles filed a claim against Gold Club-LA, a topless establishment in Harbor City, alleging they were forced to dance, waitress, clean tables, perform lap dances and work regularly scheduled, eight-hour shifts without being paid an hourly wage.
The women testified they were forced to pay $10 stage fees for each shift they danced, and made to share 10 percent of their tips with the strip club's bartenders, DJs and security guards.
"We had to dance, clean mirrors, clean tables, serve drinks and food and clean up around the club after closing, and we weren't getting paid anything except tips, which we had to share with practically everyone," said Malaise, who worked at the club from May to October 2004. "It was like slave labor."
An attorney for the club contended that the women were independent contractors not subject to labor laws that apply to employees.
The cabaret is owned by Charles "Jerry' Westlund Jr., who also owns the Fantasy Castle in Signal Hill and the Fantasy Ranch in Long Beach. His attorney argued that Westlund shouldn't be held responsible for labor practices at the club before he purchased it in May 2004.
"Most of the award is reflective of conduct before the Westlund group took over the club," said attorney Gregory Silver of Long Beach. "If you're not there, you don't have any ability to control the situation that you didn't know about."
Silver said dancers are no longer allowed to serve drinks, clean or waitress, and they may come and go as they please.
"They are absolute independent contractors, and they sign agreements to that effect," Silver said.
In the 18-page ruling handed down this week, California Labor Commissioner Fern Carrasquillo found that the club violated several labor laws, including not paying taxes and Social Security withholdings and forcing dancers to pay stage fees before they danced.
"No employer can legally charge its employees a fee in order to work for the employer or a fee for use of the stage in carrying out the work that the employee was hired to perform," Carrasquillo wrote.
DeMassi, who worked at the club under the stage name "C.J." from March 2001 to October 2004, was awarded $45,350.30 for unpaid wages, interest, stage fees and tips. Malaise, who now lives in Los Angeles and owns an adult furniture business, Adult Depot, was awarded $8,824.34.
The women, who did not disclose their ages, were represented by attorney Steve Renshaw. The lawyer predicted more women would be coming forward to report similar working situations.
"I'm sure additional lawsuits will be brought, and from what I've heard, it was common practice not only at these clubs, but others," Renshaw said.
For DeMassi and Malaise, the ruling is a small victory for workers in an often ridiculed business.
"Working in the entertainment industry is hard enough," Malaise said. "Hopefully, speaking out will help other dancers recover lost wages and compel more clubs, owners and managers to get it right."
It isn't the first time Westlund's business ventures have been investigated by federal authorities. In 1998, Westlund was found guilty of forgery and tax evasion and sentenced to probation and community service.

Let me know if you also filed with the EEOC, and remember that there is a 300 day statute for filing in the EEOC.
Without looking at the pleadings, things on the surface look nice. Best of luck on this one, it should be a bit of a good time, and don't get frustrated with the "Kafkaesque" nature of the legal process. It is all part of the panoply that is the legal system of America.

Listen, the person at the EEOC told you the wrong information. In fact, if you were working for a Federal Agency, you could NOT file through the EEOC. The EEOC is for all things, OTHER than federal agencies.
Why is it a federal case? This is why:
Title VII protects employees in private, state, municipal, etc. from discrimination and harassment, including sexual harassment in the workplace. It is a federal statute, passed by Congress, which is why discrimination and harassment are federal cases. Whistle Blower, also called CEPA, are also federal cases, but under a different statute, not Title VII. I do not know a lot about CEPA, except that I went once to an attorney to consult on a potential CEPA case myself. But I can also tell you that people who have successfully lodged and won CEPA cases don't do very well in life. No one will hire them after that, they are all afraid that the whistle blower, will blow the whistle on the new employer. I once saw a TV show on it and it showed the resultant job history of these people and they were all unemployed.
In the meantime, pursue your State case against this guy, but the whistle blower statute, CEPA is a federal statute, that protects people who tell the truth about their employers, when they are doing something dirty.

The council of memphis is meeting again in june and I will be sharing my inside info with the goal of making the strip clubs a place where we can lapdance without hookers or cops scrwewing things up. He just had to move out of his quarter million dollar complex behind the club where he was illegally living. He's back at the Peabody Hotel.
I saw Westlund today on MANswers, the Spike TV television show, promoting his club while smoking what had to have been a primo cigar. It seems he's doing fairly well in spite of all the bashing going on here.
Man up guys... Westlund's not above the law, he just got rid of an obvious problem (who went off the deep end here on a blog), and he appears to be a bit judgment proof.

You are reallly quick to print all the information from ABC on violations at tyhe Gold Club, but what you fail to mengtion is that the majority, inn fact all except oner violation took p-lace before Mr. Westlund purchased thwe Club in May 2004. All the comments that you printed with the club owner being so beligerant to the strippers like the one telling them to bring their daughters and then they would talk, you fail to mention that these were made by the previous club owner, not and I REPEAT, NOT BY MR. WESTLUND. If you are going to supposedly tell the truth here why don't you tell the entire truth?
